Description of Subjects/Issues The proposed rule revisions to 12 CCR 2509-8; Section 7.701 - General Rules for Child Care Facilities are needed to support adjustments in current practice for licensed providers in the state of Colorado. Updates are needed primarily to remove the Colorado Department of Early Childhood (CDEC) language that was removed when CDEC split from CDHS, thus removing language that is no longer pertinent to CDHS or programs that it administers. The purpose of the proposed rule revisions also includes adjustments to the fee schedules to adjust for inflation, as well as adding language removed from other sections in 12 CCR 2509-8 that apply to most facility types. For example, definitions were removed from other areas within the rule and added to 7.701 so that all definitions would be in one central location as universally applicable to all 24-hour licensed facility types.

Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
