Description of Subjects/Issues |
The Supplemental Nutrition Assistance Program (SNAP) is a federal food assistance program actively administered in Colorado. SNAP provides food assistance benefits to help low-income households purchase food. The United States Department of Agriculture, Food and Nutrition Service (FNS) annually evaluates federal income poverty guidelines and cost of living increases to determine appropriate adjustments to income eligibility standards, benefit allotments, and deductions for the upcoming federal fiscal year (FFY). The modified figures are typically made available to states during the August immediately prior to the next fiscal year. The cost-of-living adjustments (COLA) in this regulation package are required to become effective 10/01/2024. Additionally, Colorado introduced a new program called Energy Electronic Benefit Transfer (E-EBT) that works alongside SNAP to help increase SNAP households’ benefits by granting them the highest utility allowance through receipt of E-EBT. This rule incorporates this change as the new program must also be in place by October 2024. |

Lastly, the Fiscal Responsibility Act of 2023, increased the upper age limit of Able-Bodied Adults Without Dependents (ABAWD), with the final increase set for age 54 by October 1, 2024. |

Comments |
CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Emergency rules (ER) are adopted immediately, and are permanently adopted at a second hearing, usually the month after the initial hearing.
