Description of Subjects/Issues |
Senate Bill 23-039, Reduce Child and Incarcerated Parent Separation, was passed during the 2023 Colorado legislative session. The purpose of the law is to normalize the child/youth/parent relationship, to support and encourage healthy child development, and to reduce recidivism and intergenerational incarceration. The Colorado Department of Human Services has been tasked with promulgating rules that facilitate communication and family time between children/youth and their parents who are incarcerated in a Department of Corrections facility, a private correctional facility under contract with the Department of Corrections, or a jail. |
Purpose/Objective of Rule |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
