Purpose/Objective of Rule On October 12th, 2023, the Social Security Administration (SSA) announced a3.2% Cost of Living Adjustment (COLA) for all Social Security and Supplemental Security Income (SSI) recipients effective January 1, 2024. Colorado has a Maintenance of Effort (MOE) requirement with the SSA that requires the State to “pass through” the COLA increase to recipients in order to spend at least the same amount on these Adult Financial benefits in the current year as in the year prior. This means an increase is required in the Adult Financial grant payments for those receiving Old Age Pension (OAP) and Aid to the Needy Disabled - Colorado Supplement (AND-CS) assistance. These rules react to the increase to the SSI maximum payment by twenty-nine dollars ($29) ($914 x3.2% = $29.24; (SSA round down to the whole dollar $29.00). This rule will increase the AND-CS grant standard to ($914 + $29 = $943) $943 per month, and the OAP grant standard to($952 +29 = $981) $981 per month.

Comments CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Emergency rules (ER) are adopted immediately, and are permanently adopted at a second hearing, usually the month after the initial hearing.
