Description of Subjects/Issues The federal government incentivizes states to operate an effective child support program by annually distributing incentive money to states based on child support collections and performance on five metrics. In 2021, the Division of Child Support Services (DCSS) learned of an opportunity to potentially increase Colorado’s share of federal incentives by more accurately reporting collections on a specific case type. This required a programming change to the Automated Child Support Enforcement System (ACSES) that was completed in late 2021. The first full year of increased incentives earned due to this programming change is FFY 2022. The incentives for FFY 2022 will be received around March of 2024. House Bill 22-1360, signed into law on June 3, 2022, provides the option to use this increased incentive funding for ACSES enhancements. The bill requires rules to be promulgated implementing a process by which a statewide association of human services directors and the state department determine whether to retain a percentage of the federal child support incentives received for the purposes of enhancements to ACSES. This proposed rule change defines the collaborative decision-making process.

Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
