The rulemaking authority for these rules is found in Section 22-51-102(3), C.R.S., Section 22-32-114, C.R.S., Section 42-4-1903(7), C.R.S., Section 42-4-1904(4), C.R.S., Section 42-2-401, C.R.S., Section 42-4-1902, C.R.S., Section 42-4-1903(5), C.R.S., Section 22-32-113(2), C.R.S., Section 42-4-1904(1), C.R.S., Section 42-4-1903(2)(b), C.R.S., and Section 42-4-707, C.R.S. Additionally, the rules are informed by Federal Motor Carrier Safety Regulations, 49 CFR Parts 380, 382, 391, 395, 396. |
| Description of Subjects/Issues |
The rule updates are designed to align with federal standards, reflect current industry practices, and incorporate recommendations from Colorado school transportation professionals. In addition, various “clean up” language changes have been incorporated to provide more clarification on the requirements. |
| Purpose/Objective of Rule |
The Department of Education has worked with school district, charter school, and service provider transportation professionals to update two sets of rules related to transportation: 1 CCR 301-25: Colorado Minimum Standards Governing School Transportation Vehicles and 1 CCR 301-26: Colorado Rules for the Operation, Maintenance, and Inspection of School Transportation Vehicles.
These rules updates are designed to align with federal standards, reflect current industry practices, and incorporate recommendations from Colorado school transportation professionals. |
