Description of Subjects/Issues |
Ukrainian Humanitarian Parolees were made eligible immediately for benefits and services in the federal Additional Ukraine Supplemental Appropriations Act. Current rules do not allow eligibility for this population and are out of alignment with the new federal law. Thus, ensuring the inclusion of their new categories and verification of status documents in the state rules, will bring uniform knowledge of categories, public benefits eligibility, and support from all parties involved, and allow CRSP to provide services to this population. |
Purpose/Objective of Rule |
The Additional Ukraine Supplemental Appropriations Act, 2022, part of Public Law 117-128, was signed into federal law on May 21, 2022. The Appropriations Act established eligibility for federal benefit programs for Ukrainian Humanitarian Parolees, which are to be treated as refugees for benefits purposes. Pub. L. 117-128, Title IV, § 401(a), (b). The Colorado Refugee Services Program (CRSP) proposes the inclusion of new Office of Refugee Resettlement (ORR) eligible categories of Ukrainian population groups into the state rules, in response to the ongoing resettlement of the Ukrainian population to the State of Colorado. The proposed rule will ensure that the new categories of Ukrainian population groups and the document types, necessary for proof of their status, are clearly reflected in the state rules. |

CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
