Description of Subjects/Issues |
This is the annual update to the LEAP rules. Many revisions revolve around the removal of the lawful presence requirement as it is not federally mandated (verifying citizenship/lawful permanent residency is a federal requirement) and it is no longer required by the state. Additional changes include to: add a definition to questionable information as it is used throughout the rules; To add clarification to the presumption of marriage rule to indicate how the presumption of marriage can be verified; To remove the allowance of recovery from the current assistance amount; To add trust income as a form of countable unearned income to add clarification for eligibility technicians on how to treat trust income; To update the reference of the 60% State Median Income Limits to FFY 2022; To allow for a collateral contact to be used for verification of a loan; Annual update to the flat rate chart rule, to remove the dollar amounts from the rule packet so that it does not have to go in front of the board every year when it is updated in the training manual annually Please check here for any updates on location/connection: https://cdhs.colorado.gov/sbh |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
