Statutory Authority Sections 25-7-105(1), 25-7-105(1)(e), 25-7-105(1)(e)(II) and (IV), 25-7-105(1)(e)(V), 25-7-105(1)(e)(VI), 25-7-105(1)(e)(IX), 25-7-105(1)(e)(XIII); Sections 25-7-102, 5-7-102(2)(g); 25-7-103(11); 25-7-106; 25-7-109(1), 25-7-109(2)(c); and Sections 24-4-103 and 25-7-110, 25-7-110.5 and 25-7-110.8 C.R.S., as applicable and amended.
Description of Subjects/Issues To address the issues which were bifurcated from the August 2021 rulemaking hearing. The Commission will consider revisions to Regulation Number 22, Part B to include a new section for Greenhouse Gas Emissions and Energy Management Program for Industrial Manufacturers (GEMM) in Colorado to conduct an audit of their operations every five years to determine whether they are using the best available technologies and the best available energy efficiency practices to reduce GHG emissions. Proposals that direct Energy-Intensive, Trade-Exposed manufacturing sources to reduce emissions in accordance with C.R.S. 25-7-105(1)(e)(XIII)(B) are within the scope of this rulemaking hearing.
