Description of Subjects/Issues |
The proposed rule update will align with statutory language and changes to age of consent for outpatient psychotherapy. The proposed rule update adds language that addresses psychotherapy consent age as established by HB 19-1120. HB 19-1120 added a ‘’protection’’ for certain professionals to provide outpatient psychotherapy services to minors 12 years of age or older, with or without parent/guardian consent. The rule update allows, but does not require, certain professionals to provide psychotherapy services to youth 12-15 years of age, by referencing and
repeating statutory language created by HB 19-1120.

Purpose/Objective of Rule |
The proposed rule update will align with statutory language and changes to the age of consent for outpatient psychotherapy. The proposed rule update adds language that addresses psychotherapy consent age as established by HB 19-1120. HB 19-1120, as implemented in section 12-245-203.5, C.R.S., allows certain professionals to provide outpatient psychotherapy services to minors 12 years of age or older, with or without parent/guardian consent. The rule update allows, but does not require, certain professionals to provide psychotherapy services to youth 12-15 years of age, by referencing and repeating statutory language created by HB 19-1120. |

CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
