Description of Subjects/Issues |
The proposed rules in Quality Standards for 24 Hour Care support the mandatory Federal legislation for Family First Prevention Services Act (FFPSA), to be implemented in Colorado in October, 2021. Such Federal legislation requires changes to the admission of and treatment services provided to children/youth to residential child care facilities. The proposed rules in the Rules Regulating Residential Child Care Facilities also support the mandatory Federal legislation for the FFPSA, including defining and creating rules to regulate the Qualified Residential Treatment Programs (QRTP) to be used for children/youth who received IVE funding and are in need of residential child care treatment services.

Purpose/Objective of Rule |
The proposed rules in Quality Standards for 24 Hour Care support the mandatory Federal legislation for Family First Prevention Services Act (FFPSA/Family First), which was signed into law in 2018 and must be implemented in all states no later than October 1, 2021. The Federal legislation requires changes to admission procedures and treatment services provided to children/youth in residential facilities.
The proposed rules in the Rules Regulating Residential Child Care Facilities also support
FFPSA/Family First, including defining and creating rules to regulate the Qualified Residential Treatment Programs (QRTP) to be used for children/youth who receive federal funding and are in need of the level of services provided in residential child care treatment settings. |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
