Purpose/Objective of Rule |
On August 24, 2020, Governor Polis issued Executive Order D 2020-173 temporarily suspending the portion of C.R.S. § 44-30-508(3) that prevents a casino operator from dividing its lawful gaming space into more than two noncontiguous spaces. Executive Order D 2020-173 authorizes the Commission to adopt emergency rules allowing the Division Director to approve additional noncontiguous gaming areas, while maintaining constitutional, statutory, and regulatory requirements. The purpose of the adoption of Emergency Regulation 30-313.5 is to create a safer environment for gaming patrons by allowing the 35% of the total square footage of gaming space to be spread over more noncontiguous spaces, thus allowing for greater ability to socially distance gaming patrons and machines to ensure licensed gaming operations are conducted to maintain the public health, safety, and welfare of gaming licensees, the gaming public and Division employees. Emergency Regulation 30-313.5 will immediately allow the implementation of Executive Order D 2020-173. |
