Description of Subjects/Issues |
This rule packet includes proposed changes to the Rules Regulating Foster Care Homes in 12 CCR-2509-8. The purpose is to meet or be in reasonable accord with the National Model Foster Family Homes Licensing Standards (herein referred to as national model standards) that were issued by Health and Human Services (HHS). The national model standards are required in Public Law (P.L) 115-123, the Family First Prevention Services Act. Meeting or being in reasonable accord with the national model standards is tied financially to the State Title IV-E Plan, which authorizes the Colorado Department of Human Services (CDHS) to access federal reimbursement for eligible children/youth in foster care. Division of Child Welfare (DCW) staff cross referenced the national model standards with the Rules Regulating Foster Care Homes. A number of rules required revision and there were identified areas requiring new rules.

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
