Description of Subjects/Issues |
The Transportation Commission of Colorado ("the Transportation Commission") desires to modify the rules governing the Emerging Small Business ("ESB") Program in Colorado, 2 CCR 604-1. The Transportation Commission proposes to repeal and re-enact the rules in order to re-format the numbering of the administrative rules for easier use. Additionally, the Transportation Commission proposes to make rule changes for the purposes of streamlining the ESB Program’s certification and administrative requirements, better aligning the ESB Program with the administration of the Colorado Department of Transportation’s (“CDOT”) Disadvantaged Business Enterprise Program (“DBE Program”), and enhancing program participation within Colorado’s small business community. Three distinct size levels for certified Emerging Small Businesses will be established based on the Small Business Administration’s size standards for small businesses in a given industry and the current overall cap of the DBE Program, which will expand program participation and allows CDOT to better tailor program incentives towards certified Emerging Small Businesses. Purpose/Objective of Rule |
The rulemaking achieves the following goals, which include: (1) re-indexing the numbering of the administrative rules into a new format that is more user-friendly, (2) streamlining the certification and administrative requirements, (3) better aligning the Emerging Small Business (ESB) Program with the administration of CDOT's federal Disadvantaged Business Enterprise (DBE) Program, (4) adding a third size level for certified ESBs which allows CDOT to facilitate greater DBE and small business participation through the ESB Program, including at the prime contracting level, and (5) enhancing program participation within Colorado's small business community. |
