Description of Subjects/Issues |
These proposed rule changes would impact several areas of existing rule that relate to child care facility licensing. The proposed rules: Add definitions for the following terms used in rule - Cultural Responsiveness, Trauma Informed Care, Annually, Calendar Year, and Trails; Delete numbering to allow for an alphabetized definitions section for easier reference by users; Update language to define the process currently used to obtain fingerprint background checks; Add rule to clarify documentation of and confidentiality of children/youth and their relatives’ records; Update language to clarify persons who must take training on the Reasonable and Prudent Parent Standards; Add a rule for all programs serving children/youth in 24 hour and day treatment programs to include trauma informed care in their policies, and practices and includes related training requirements; Add a rule for all programs serving children/youth in 24 hour and day treatment programs to include cultural responsiveness practices in their policies and practices and includes related training requirements; and add a rule that clarifies the process currently in place for providers to (1) access the state's Trails data base and information system to search for any history on abuse and neglect referrals for foster care and adoptive applicants, (2) to enter in any critical incident reports, and to (3) allow data entry of foster care information and issue foster care certificates. |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
