Description of Subjects/Issues SB 20-106: “Consent to Shelter and Services by Homeless Youth” was signed into law on 6/26/2020 and requires that rules be promulgated by the State Board of Human Services for implementation. The law permits youth 15 years of age and older to consent to shelter and services, allows a runaway and homeless youth (RHY) shelter director to notify the county department of child welfare of the youth’s admission to a shelter in some circumstances, and clarifies that services addressing abuse, neglect, and youth in conflict issues for runaway, homeless, and unaccompanied youth are included in the services child welfare provides. This rule making packet ensures that child welfare screening staff who take calls are asking the questions needed to ensure counties have all relevant information when a youth consents to shelter from a RYH provider. NOTE: Due to the ongoing COVID-19 situation, it is anticipated that this meeting will take place entirely online. Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
