Description of Subjects/Issues |
2.8 ELIGIBILITY REQUIREMENTS
Repeal subparagraph .11 of section 2.8.4 because the associated statute (§8-73-108 (4)(t)) was repealed in July 2019.
Add section 2.8.6 to revert it back to what it was before the pandemic and emergency rules were filed and prevent it from repealing when the emergency rule expires.
7.3 POSTING NOTICES TO WORKERS
Added because the U.S. Department of Labor requires that we notify employers that they are now required to inform employees about unemployment insurance at the time a separation occurs.
7.4 PATTERN OF FAILING TO RESPOND
Modify the prohibition of noncharging section to add a definition of fault as used in the statute.
17.3 WORKER CLASSIFICATION INVESTIGATIONS AND FINES
Amend this section to add clarity to willful disregard and change the fine structure to be applied by quarter, rather than day, which is how wages are reported to the division by employers.
18.1 WORK SHARE
Add section 2.8.6 to revert it back to what it was before the pandemic and emergency rules were filed and prevent it from repealing when the emergency rule expires.
PART XIX OPERATIONS DURING OTHER THAN NORMAL CONDITIONS
Add this new section to cover all the items that were added through emergency rules since the pandemic that the division deemed appropriate to make a permanent rule and to bring all considerations as a result of an emergency such as a pandemic into a single section rather than have to refer to many different parts of the rules. |
