Description of Subjects/Issues |
The Division of Child Support Services is proposing several rule changes to ensure county child support offices provide consistent and equitable services to families across the state. Specifically, the proposed rules will provide a standard modification process for individuals that are incarcerated and sentenced to 180 days or greater. Additionally, standards will be created to ensure the order for current support does not commence retroactively; rather all orders for current support may only commence prospectively. The proposed rule changes also provide county child support professionals with additional closure options; unenforceable and tribal closure reasons are defined. This rule packet also includes technical amendments to ensure clarity and accuracy of the existing rule.

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
