Purpose/Objective of Rule |
The Department would like to amend current rule to expand the allowable reasons a county may choose to waive parent fees for families in the Colorado Child Care Assistance Program (CCCAP) to include the option for a county to waive parent fees in the event of a declared state or local emergency or disaster. In addition, the Department would like to amend current rule to allow the waiver of parent fees without providing the fifteen day notice as well to allow the waiving of parent fees retroactively to the beginning of the current month to best support families and providers in the event of a declared state or local emergency or disaster. Because federal guidance was provided that under 45 CFR 98.45(k)(4), Lead Agencies have the option to waive family co-payment requirements for families that meet criteria established by the Lead Agency, the Department believes this amendment is necessary to preserve the health, safety and welfare of families receiving CCCAP. This was an emergency rule adoption, and it is anticipated that a permanent adoption will occur in June 2020 through SOS# 2020-00279. |

CDHS typically holds 2 public hearings, an initial and final, for each proposed rule. The initial hearing allowing the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Emergency rules (ER) are adopted immediately, and are permanently adopted at a second hearing, usually the month after the initial hearing. This rule was adopted on an emergency/temporary basis and it is anticipated that it will be adopted on a permanent basis through SOS# 2020-00279.
