Statutory Authority C.R.S. § 24-4-103, and the provisions of Articles 1, 4, and 6, including C.R.S. §§ 8-1-101, 8-1-103, 8-1-107, 8-1-108, 8-1-111, 8-1-130, 8-4-111, 8-6-102, 8-6-104, 8-6-105, 8-6-106, 8-6-108, 8-6-109, 8-6-111, 8-6-116, 8-6-117, and 8-12-115 (2020)
Description of Subjects/Issues These rules conform Colorado Overtime and Minimum Pay Standards Order (“COMPS Order”) #36, 7 C.C.R. 1103-1, to recent wage law developments and other imperatives identified late in the process of adopting COMPS Order #36 in early 2020. The Director finds that those needs are best served by these rule updates, amendments, and supplements. The proposed rules amend current COMPS Order #36 by adding new rule 1.6.1 (defining joint employment) and new rule 2.2.7(G) (overtime exemption for (companions”), and by modifying rules 5.2.1(B) (additional rest period flexibility for certain Medicaid providers), and 7.2-7.3 (additional earnings statement flexibility for employers).
