Rule 8.5 amended language from Rule 19 in the pre-amended Minimum Wage Order #35, which existed under the same CCR number. In the rulemaking process, the Division amended this rule to list for our stakeholders all statutory citations that gives the Division authority to penalize employers for potential reprisals, which was previously missing in the pre-amended rule. During the rulemaking process, the Division intended to list all statutory references, and inadvertently forgot to list a citation to C.R.S. 8-1-140. This omission is nonsubstantive and including it provides readers of our rule with a thorough list of all applicable statutory citations, which ultimately benefits those readers. |
