Statutory Authority Sections 42-20-108 (1)(2), 42-20-403, 42-20-504, 42-20-508 and 42-20-108.5 of the CRS provide the statutory authority for the CSP Chief to promulgate these rules.
Description of Subjects/Issues These rules are being amended to update references to federal regulations and state statutes; to update references to out of service and hazardous response criteria; to elaborate upon previously adopted criteria required for hazardous materials routing applications; to clarify the requirements of law enforcement officers performing inspections pursuant to the CVSA North American Operations Manual; to incorporate the most current version of the Emergency Response Guidebook; and to correct minor grammar, formatting and website address information as it exists in the present rules.
Purpose/Objective of Rule The purpose of these rules is to effectively regulate the permitting, routing and safe transportation of hazardous materials by motor vehicles within the state of Colorado. These rules are also promulgated to regulate the permitting, routing, and safe transportation of all nuclear materials by motor vehicles within the state of Colorado. Finally, the purpose of these rules is to allow for the Chief of the CSP to exercise statutory authority as provided to adopt rules and regulations exempting agricultural products from the hazardous materials rules. Changes proposed to these rules amend and confirm references to both federal regulations and state statutes; update references to out of service and hazardous response criteria; elaborate and clarify previously adopted federal criterial impacting hazardous materials route applications submitted by petitioning entities for new and existing routes; clarify requirements applicable to law enforcement officers performing inspections pursuant to the CVSA North American Operations Manual; incorporate the most current version of the Emergency Response Guidebook published by the US Department of Transportation and correct minor grammar, formatting and website address errors.
