Description of Subjects/Issues |
On November 21, 2019, the CDOT received approval from the Transportation Commission (TC) to adopt emergency rules amending 2 CCR 601-14, the Rules Governing Chain Law and Passenger Vehicle Traction Law Requirements on the State Highway System, aka the "Chain Rules." These adoptions were made to make the rule more clearly consistent with recently revised statute and to clarify how CDOT would communicate information related to the new Passenger Vehicle Traction and Chain law to the motoring public when in effect or being deactivated. CDOT also requested and received permission to pursue a permanent rulemaking cycle on these same rules for purposes of making the emergency adoptions permanent and making other minor corrections to the rule overall. Ultimately, these changes update the rules to be consistent with 42-4-106, CRS, correct formatting issues, elaborate upon when and through what means CDOT will communicate with the public, reflecting the now widespread use of electronic signs and other technology, and address other provisions of this rule on the grounds of clarity, accuracy and completeness as is required by the Colorado Administrative Procedure Act. |
Purpose/Objective of Rule |
The purpose of these rules is to describe the travel conditions, types of vehicles, and the locations which require chains, adequate types of tires, four-wheel drive or other means of traction to provide adequate traction, when the Department determined such means are necessary to protect the safety of the traveling public and to minimize the occurrence of road closures. |

The public rules hearing for the rules was held on Tuesday January 14, 2020. Following the hearing, these rules were presented to the Transportation Commission on Thursday, January 16, 2020, where the TC took action to approve the adoption of these rules. |
