Description of Subjects/Issues Through regulating DUI/DWAI Education and Treatment Providers, the Office of Behavioral Health ensures individuals in Colorado have access to quality offense-specific education and treatment services. This increases the safety of Colorado residents by helping these individuals better understand issues related to using drugs or alcohol in combination with driving, as well as satisfy supervision and Division of Motor Vehicles requirements that allow for an individual’s safe return to driving. This rule update is necessary to promote ease of access and understanding of rules and regulations regarding delivery of DUI/DWAI services for treatment providers. This allows treatment providers to focus more time on delivering quality services to the DUI/DWAI-involved individuals of Colorado. Further, this rule revision increases the scope of treatment providers to consider and grant credit for individuals participating in prior or concurrent education or treatment services with non-DUI/DWAI or out of state providers.
Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
