Description of Subjects/Issues Through regulating behavioral health facilities, the Office of Behavioral Health ensures individuals in Colorado have access to quality mental health and substance use services. The rule update is necessary to ensure individuals in Colorado receive behavioral health services from behavioral health facilities and programs that employ personnel who adhere to ethical standards and that behavioral health care and treatment is provided by personnel credentials to provide that care and treatment. The rule change specifically does three things: 1.) ensures all personnel at facilities and programs licensed or designated by the Office of Behavioral Health, no matter their individual credentials, follow ethical standards; 2.) expands who can oversee the day-to-day operations at a non-hospital residential withdrawal management facility because currently only a CAC III is allowed to oversee the day-to-day operations; and, 3.) establishes minimum credentialing standards for the staff providing the care and treatment to individuals on an emergency commitment.

Comments CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
