Purpose/Objective of Rule Basis: The basis for the revision of the following rules are provided in sections 12-25-107(1)(a) and 12-25-207(1)(a) of the Colorado Revised Statutes, and for the preservation of the public welfare pursuant to section 24-4-103(6), C.R.S. Purpose: The purpose is to re-adopt existing emergency rules without amendments and is a continuation of the emergency rules adopted on April 12, 2019 with an effective date of May 15, 2019 (2019-00165). This is imperatively necessary in order to comply with section 24-4-103(2), C.R.S., regarding required stakeholder engagement. An effort to comply with this statute was scheduled for June 7, 2019 through a stakeholder engagement meeting to consider the permanent adoption of these rules but due to an internal technical error that occurred when noticing the meeting, the meeting was not considered successful stakeholder engagement. The rule revisions themselves were found to be imperatively necessary to comply with state law, specifically sections 12-24-108(1) and 12-24-208(1), C.R.S., and for the preservation of the public welfare pursuant to section 24-4-103(6), C.R.S. Specifically, the Board finds it is imperatively necessary to adopt revisions to Section 4, Rules of Administrative Procedure, 4.6 Engineering and Land Surveying Application Criteria, and 4.8 Examinations, in order to expedite and facilitate the licensure process as set forth in sections 12-25-110 through 12-25-114, C.R.S., and sections 12-25-210 through 12-25-214, C.R.S., in regards to engineer and land surveyor application for enrollment and licensure: Rule 4.6.5; and Rule 4.8.1 See Justification below and in the attached document.

Comments Justification: The public welfare imperatively requires the emergency adoption of the revisions to the rule to ensure a competitive marketplace, increase the number of persons contributing to the state's economy, reduce barriers to timely licensure of qualified individuals, and improve mobility of the profession and based on an internal technical error, the early stakeholder engagement and meeting for the permanent rules was not properly executed.
