Description of Subjects/Issues |
Per SB 18-254 Section 6, 26-5-104.6(b): Creates rules for the methodology by which counties may negotiate rates and services with out-of-home care providers. Per SB 18-254 Section 4, 26-5-102(b): Creates rules for the placement of youth into the facility (IDD Facility) serving youth with intellectual and developmental disabilities to include QA, admissions, discharge, length of stay, appeals process for eligibility, and reimbursement to county departments for payments made to the IDD Facility.
County departments of human/social services are reimbursed for child welfare services when State program and fiscal requirements are met at eighty percent (80%). Per 26-5-1-4 (1)(b), county departments of human/social services are now reimbursed for adoption and relative guardianship assistance when State program and fiscal requirements are met at ninety percent (90%). County departments of human/social services contract with licensed out-of-home placement providers of this rule for services for children/youth. These rules are revised to reflect the work of an independent contractor directed under HB 17-1292 to perform an actuarial analysis and salary survey to create a provider rate methodology. |

Comments |
CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.
