Description of Subjects/Issues |
Proposed permanent rules for the Division of Conservation. Emergency Rules (chapters 2, 3 & 4) were adopted 12/21/2018. These proposed permanent rules include the three emergency rules plus one new rule consisting only of definitions (chapter 1). Changes to the emergency rules are minor, affecting only chapter 2. They have been red-lined. |
Purpose/Objective of Rule |
Chapter 1 defines terms not defined in statute. Chapter 2 is necessary because section 12-61-1104, C.R.S., requires the Division of Conservation, in consultation with the Conservation Easement Oversight Commission, to establish minimum qualifications for organizations that hold conservation easements to encourage professionalism and stability. Chapter 3 addresses section 12-61-1104(7), the adoption of best practices, processes, and procedures used by other entities that regularly review conservation easement transactions, including a practice, process, or procedure deeming qualified conservation easement appraisals approved by these entities based on their independent reviews as credible for purposes of the conservation easement tax credit. Chapter 4 sets program fees for 2019, pursuant to section 12-61-1104(7)(a), (b) & (c) |
