During the rulemaking, the Board adopted a new section of rule found at Rule 306, Section 2. The new language was inserted between Section 1 and the previous Section 2, titled "Mandatory Transfers and Consideration for Transfer. As such, this provision was correctly renumbered as Section 3. The rulemaking packet indicated "*****" which communicates that the subsequent sections are not being revised. However, in fact, Section 3, titled "Expanded Scope Required Resources" should be renumbered to Section 4. Similarly, what was Section 4, titled "Performance Improvement and Patient Safety" should be Section 5. In short, the rulemaking packet did not include a note to "renumber the subsequent sections." |
