Description of Subjects/Issues 4-2-61 CONCERNING NON-CONTRACTED EMERGENCY ROOM CLAIMS - The purpose of this regulation is to establish requirements for carriers to provide in-network cost-sharing for out-of-network emergency room claims and prohibit carriers from limiting coverage for emergency services to only in-network facilities, pursuant to § 10-16-704(5.5), C.R.S. Further, this regulation seeks to address the issue of provider contracting practices and how non-participation in carrier networks may lead to increased premiums and increase the cost of care.

Reason The Colorado Legislature passed of House Bill 19-1174, Concerning out-of-network health care services provided to covered persons, during the 2019 legislative session, and which was recently signed into law. The signing of this bill into law makes promulgating the revisions to draft amended regulation 4-2-53 and the promulgation of draft new regulation 4-2-61 no longer necessary.
