CDHS holds two public hearings, an initial and final, for each proposed rule packet.
The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule.
The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule.

Purpose/Objective of Rule |
Senate Bill 17-207 made a requirement for emergency medical services facilities (emergency departments) to annually report data to the Office of Behavioral Health on individuals treated in their facilities under the emergency procedure provisions of Title 27, Article 65, C.R.S, the Care and Treatment of Persons with Mental Health Disorders. The proposed rules establish what data shall be submitted and the procedure for how these emergency medical services facilities report their data to the Office of Behavioral Health.
In addition to creating data reporting requirements for emergency medical services facilities, the proposed rules update the data reporting requirements for designated facilities to ensure the data received by the Office of Behavioral Health is consistent between designated and non-designated facilities. |
