Description of Subjects/Issues "See attachment for detailed description. CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Purpose/Objective of Rule Agencies licensed or designated by the Office of Behavioral Health must submit a renewal application every two years. Current rule allows agencies to have their license or designation stay in effect after the expiration date as long as OBH receives the renewal application on or before the date of the expiration. Other OBH rules require licensing renewal applications be submitted to OBH 60 days prior to the expiration of the license, creating inconsistency in the licensing renewal process and allowing agencies to operate after their license has expired. The proposed rule removes the regulatory provision that a license or designation remains in effect during the approval process when a renewal application is submitted to OBH on or before the current expiration date. This requires agencies to submit their renewal application 60 days prior to the expiration of their current license or designation, which is a current OBH rule.
