Description of Subjects/Issues "See attachment for detailed description. CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Purpose/Objective of Rule This rule update aligns Behavioral Health Rule Volume 2 CCR 502-1 with the federal requirement for incorporation by reference established in 1 CFR Part 51. This rule update also removes outdated and inconsistent regulatory requirements in Rule Volume 2 CCR 502-1 Section 21.240: DUI/DWAI, BUI, and FUI Education and Treatment. The rule change removes the requirement that individual records must contain pre and post-tests, because some approved DUI curriculums do not require pre and post-tests. The update also removes the rule that DUI/DWAI Enhanced and Intensive Outpatient Therapy shall include no more than two hours of level II therapy because, this rule creates confusion and inconsistencies as it potentially limited services than an individual may need as identified by their individual assessment.
