Description of Subjects/Issues See attachment for detailed description. CDHS holds two public hearings, an initial and final, for each proposed rule packet. The initial hearing allows the public an opportunity to submit written data, views, or arguments and to testify for or against the proposed rules. The Board does not vote on the proposed rule at the initial hearing, but asks CDHS to consider all public comment and discussion and, if needed, submit revisions to the proposed rule. The final hearing, usually the month following the initial hearing, allows the same opportunity for public comment, after which the Board votes on final adoption of the proposed rule. Purpose/Objective of Rule To ensure individuals in the criminal or juvenile justice system and the community behavioral health system have access to a broad spectrum of effective medications, Senate Bill 17-019 (27-70, C.R.S.) requires the Department of Human Services to promulgate rules that require providers under the department's authority to use a medication formulary that outlines required medications that are to be made available across all public systems to treat behavioral or mental health disorders. The proposed rule requires the facilities designated by or contracting with the Office of Behavioral Health to use the medication formulary that was developed in partnership with the Department of Corrections, agencies, and providers.
