Statutory Authority |
The State Licensing Authority promulgates these rules pursuant to the authority granted in the Medical Code, The Retail Code, Article XVIII, Section 16 of the Colorado Constitution, and section 24-4-103, C.R.S., of the Administrative Procedure Act. |
Description of Subjects/Issues |
M 200 Series – Licensing and Interests: Rules M 207, 207, 209, and 210 are under consideration for procedural and substantive amendments. Any proposed changes to the M 200 Series that are not included in the initial attached proposed rules will be included in the full set of proposed rules to be posted by March 27, 2018.
M 700 Series – Medical Marijuana Testing Facilities: Rule M 705 is under consideration for procedural and substantive amendments. Any proposed changes to the M 700 Series that are not included in the initial attached proposed rules will be included in the full set of proposed rules to be posted by March 27, 2018.
M 1500 Series – Medical Marijuana Testing Program: Rule M 1504 is under consideration for procedural and substantive amendments. Any proposed changes to the M 1500 Series that are not included in the initial attached proposed rules will be included in the full set of proposed rules to be posted by March 27, 2018.
M 1700 Series – Medical Marijuana Operators: Rules M 1701, 1702 and 1703 are under consideration for procedural and substantive amendments. Any proposed changes to the M 1700 Series that are not included in the initial attached proposed rules will be included in the full set of proposed rules to be posted by March 27, 2018.
Any other rules necessary to implement the Medical Code may be amended or adopted. |
Purpose/Objective of Rule |
The State Licensing Authority adopted emergency medical and retail rules (1) to set the fee amounts of two new license types established under House Bill
17-1367, effective August 9, 2017; (2) to amend provisions contained in the Medical and Retail Rules 1700 Series related to Medical and Retail Marijuana
Operator Licenses, including amendments to implement House Bill 17-1034; and (3) to address industry impacts of rules applicable to Medical and Retail
Marijuana Testing Facilities, reflected in the M and R 700 Series and 1500 Series rules, 1 CCR 212-1 and 1 CCR 212-2, by clarifying test sample size
requirements and sample retention requirements. The purpose of the medical and retail marijuana rules included herein is to establish the previously adopted emergency rules as permanent. |
