Regulations related to 1) off-premise permits (a NEW rule), 2) license application processes (a NEW rule), 3) signage for dealerships, 4) delegation of Board’s authority to the Executive Secretary for ministerial actions, 5) substituted service of process, 6) ANSI requirements, and, 7) delegation of the Board’s authority to enter a default against a licensee (a NEW rule). |
Purpose/Objective of Rule |
This rule-making includes new and revised rules specific to the following topics: 1) off-premise permits (NEW), 2) license application processes (NEW), 3) signage for dealerships, 4) delegation of Board’s authority to the Executive Secretary for ministerial actions, 5) substituted service of process, and, 6) delegation of the Board’s authority to enter a default against a licensee (NEW). The specific purpose(s) for each new or revised rule has been submitted with the Adopted Rules document, itself. |
Comments |
The adopted rules have been submitted in a "clean" format. The additional information shows the adopted rules in a traditional "redline" format. The Motor Vehicle Dealer Board convened in open session on December 6, 2017, for the scheduled rule-making hearing. A quorum of the Board was present. Each Board Member had before them a copy of the entire Rule-making Record. The Chief of Investigations of the Auto Industry Division presented the Rule-making Record. Comments were received from members of the public and from the Division’s Subject Matter Expert. The Board deliberated and voted unanimously to adopt the proposed rules before them with a few changes. This update removed Rule 12-6-504(1)(l) for later non-substantive modification, to be addressed in an Additional Rule filing related to this rule-making event. |
