| Purpose/Objective of Rule |
The purpose of this regulation is to provide the necessary guidance to carriers to ensure that health insurance rates comply with Colorado’s health benefit plan rating laws. The Division of Insurance finds, pursuant to § 24-4-103(6)(a), C.R.S., that immediate adoption of this regulation is imperatively necessary for the preservation of public health, safety, or welfare, in order to ensure consumers and carriers are aware of changes to the actuarial value calculations for 2018 plans, and to comply with federal law and federal regulation. Therefore, compliance with the requirements of § 24-4-103, C.R.S., would be contrary to the public interest. This emergency regulation replaces Colorado Insurance Regulation 4-2-39 that became effective on January 1, 2016 in its entirety. |
