Statutory Authority |
Pursuant to Sections 22-51-108 and 42-4-1904, C.R.S., the State Board of Education has the authority to promulgate rules related to school transportation including reasonable and adequate standards of safety in the maintenance and operations of buses and pupil transportation that promote the welfare of the students and afford reasonable protection to the public. |
Purpose/Objective of Rule |
Colorado law provides for the State Board of Education to adopt and enforce regulations governing the safe operation of school buses used for the transportation of students pursuant to Sections 22-51-108 and 42-4-1904, C.R.S.
The purpose of these rules is to adopt and enforce regulations governing the reasonable and adequate standards of safety for the operation, maintenance and inspection of school transportation vehicles that promote the welfare of the students and afford reasonable protection to the public. These rules are designed to align with federal standards, reflect current industry practices, and incorporate recommendations from school district and service provider transportation professionals.
The Commissioner, or designee, may provide an exemption to the Rules for the Operation, Maintenance and Inspection of School Transportation Vehicles to the extent the Commissioner finds an exemption to be appropriate.
These rules shall become effective January 1, 2017 for all student transportation.
Senate Bill 17-083, recommended by the Committee on Legal Services, reflects a review of recently adopted or amended state department rules and regulations. The Committee on Legal Services identified four technical issues with some of the State Board of Education Rules for the Operation, Maintenance, and Inspection of School Transportation Vehicles (1 CCR 301-26). As a result, the associated rules were not extended and will expire on May 15, 2017. Therefore, it is necessary for the state board to approve the emergency rules at the May meeting, in order to address the technical corrections for these rules. The state board will then consider adoption of these rules on a permanent basis by approving the notice of rulemaking at the June board meeting. |
