Statutory Authority Authority for Promulgation of Rules: Sections 12-37-103, 12-37-104, 12-37-105, 12-73-105.5, 12-37-106(1)(a), 12-37-108.5 and 24-4-103, C.R.S.
Description of Subjects/Issues Rule 1 - to make it unprofessional conduct; Rule 2 – to make technical amendments for standards of education Rule 4 – to expand, clarify, and in some cases eliminate, instances in which a direct-entry midwife may not provide direct-entry midwifery care to a mother based on current or past conditions of the mother; Rule 5 – to expand, clarify, and in some cases eliminate, the minimum requirements for a direct-entry midwife when performing antepartum care; Rule 6 - to clarify, and in some cases eliminate, the minimum requirements for a direct-entry midwife when performing intrapartum care; Rule 8 – to clarify, and in some cases eliminate, the minimum requirements for a direct-entry midwife when performing postpartum care; Rule 9 - to make various technical formatting amendments; Rule 11 - to make various technical formatting amendments for consistency with other programs and boards within the Division; Rule 17 – to clarify the use of certain medications based on the presentation of the mother at birth; Rule 18 – to clarify the use of intravenous fluids to describe the causation of fluid volume lose by the mother; Rule 20 – to define perineal tear; Rule 21 – to define both “unregistered birthing attendants” and “direct supervision”, and Rule 22 – to specify the requirements of confidential agreements. Comments The Office encourages interested parties to submit written comments to the hearing address regarding any of the above-listed rule-making matters no later than April 12, 2017. In addition, at the time and place designated in this notice, the Office of Direct Entry Midwifery will afford interested parties an opportunity to submit written information, data, views or arguments. The Office also will afford interested parties an opportunity to make brief oral presentations unless the Office in its discretion determines that such oral presentations are unnecessary. All submissions will be considered. The rules under consideration may be changed or modified after public comment and hearing.
