Description of Subjects/Issues |
1.23 Statement of Basis and Purpose for Amendment The statutory authority for the amendments to these rules is found in 22-2-107(1)(c) and 22-60.5-101, et seq, C.R.S. The purpose of the amendments is to bring the rules into compliance with state statute, pursuant to review by the Colorado Office of Legislative Legal Services. OLLS recently reviewed the rules and found several issues which did not align with statute. CDE staff worked with OLLS staff to make these technical adjustments. In working on these adjustments, CDE staff also took the opportunity to make several other technical amendments in order to bring the rules in line with current practice and fix wording and typo issues. The changes proposed in this Notice of Rulemaking are only technical in nature and do not represent any significant policy changes. The changes fall into one of five categories: OLLS recommendation; typo correction; numbering adjustment; Department recommendation to align with current practice/statute; or rule clean-up from error in previous version. CDE staff has identified the category associated with each proposed change in the annotated red-line version of the rules. |

Please note this is a continuation from the original notice, tracking #2016-0660. Minor technical changes have been made to the rules, otherwise they are the same. The February hearing date has been terminated and changed to the April hearing date due to a technical issue when filing the original notice of rulemaking. |
