Notice Filed with SOS 06/29/2016
Statutory Authority 26-1-107, C.R.S. (2016); 26-1-109, C.R.S. (2016); 26-1-111, C.R.S. (2016); 7 U.S.C. §§ 2011-2036; C.R.S. 24-30-2104(3)(c); 7 CFR 273.13(a)(1).
Description of Subjects/Issues "The purpose of the proposed rule change is to align with state statute C.R.S. 24-30-2104 concerning requirements for the Address Confidentiality Program (ACP). The ACP is intended to protect the confidentiality of the actual address of a relocated victim of domestic violence, a sexual offense, or stalking and to prevent the victim’s assailants or potential assailants from finding the victim through public records. Subsection (3)(c) of C.R.S. 24-30-2104 requires the state agency to provide additional mailing time for the household to receive certain types of correspondence. Currently, one (1) calendar day is allowed for mailing time. To align with state statute, individuals within the ACP will receive five (5) additional calendar days to allow for mailing time. Food Assistance regulations 4.604, 4.604, 4.608, and 4.802 (10 CCR 2506-1) will be updated to clarify the additional mailing time. "
