Statutory Authority The amendments to these regulations have been created pursuant to Title 8 Article 20 Section 102 and Article 20.5 Sections 202 and 302 of the Colorado Revised Statutes (C.R.S.). The design, construction, location, installation, and operation of liquid fuel systems and equipment and the handling of liquid fuels shall conform to the minimum standards as prescribed by the applicable sections of NFPA 30.
Description of Subjects/Issues The amendments to the Storage Tank Regulations 7 C.C.R. 1101-14 primarily adopt the 2015 revisions to the federal EPA’s regulations related to underground storage tanks (USTs) found in 40 CFR part 280 and 281, created pursuant to 42 U.S.C. sec. 6991 et seq. The amendments increase emphasis on properly operating and maintaining UST equipment and will help prevent and detect UST releases. Additionally, updates to sections of Article 1.5 Motor Fuel Dispensing and Product Quality and Article 5 Release Response have also been made.
Purpose/Objective of Rule The Storage Tank Regulations 7 C.C.R. 1101-14 were promulgated to establish rules for the design, installation, registration, construction, and operation of storage tanks used to store regulated substances (including petroleum), response to releases of regulated substances from these tanks, and to describe the financial responsibility of storage tank owner/operators. The main purpose of these regulations is to reduce damage to the environment and risk to the public caused by leaking petroleum storage tanks and to mitigate such damage effectively when it occurs.
