Description of Subjects/Issues #15-7-23-1: Older Americans Act and Services for the Aging Rule Revisions
Purpose/Objective of Rule The State Unit on Aging has conducted a comprehensive rule review of rules regarding the Older Americans Act and Services for the Aging. As a result, rule revisions are being proposed to provide partner agencies opportunities to expand services that assist older Coloradans with maintaining their independence and live in the community of their choice and to provide for fiscal accountability of funds. Some of the proposed revisions are necessary to bring current rules into alignment with federal requirements. A number of changes have been made to the definitions section to align with current service delivery and federal requirements. Eligibility for the National Family Caregiver Services program is being revised to match federal eligibility guidelines. Clarification is being provided for the Senior Community Service Employment Program priority of services to older veterans and allowing participants the opportunity to continue to receive employment training through extending enrollment and host agency assignment in the program. There is no longer a federal requirement that a percentage of disease prevention/health promotion services be earmarked for medication management, so this requirement is being removed. Revisions to the provision of modified diets clearly define a distinction between therapeutic diets and modified diets. Another proposed rule change eliminates the requirement for physician prescription and subsequent follow-up with physicians every six (6) months for modified diets.
