| Purpose/Objective of Rule |
The purpose of this emergency regulation is to establish rules governing enrollment periods for individual and group health benefit plans in accordance with Article 16 of Title 10 of Colorado Revised Statutes, and the Patient Protection and Affordable Care Act of 2010, Pub. L. No. 111-148, 124 Stat. 119 (2010), and the Health Care and Education Reconciliation Act of 2010, Pub. L. No. 111-152, 124 Stat. 1029 (2010), together referred to as the “Affordable Care Act” (ACA). The Division of Insurance finds, pursuant to § 24-4-103(6)(a), C.R.S., that immediate adoption of this regulation is imperatively necessary for the preservation of public health, safety, or welfare, in order to ensure consumers and carriers are aware of the upcoming open enrollment dates for 2015 coverage, to provide clarification to carriers concerning which health benefit plans are subject to the requirements of this regulation, and to comply with a federal law and federal regulation. Therefore, compliance with the requirements of § 24-4-103, C.R.S., would be contrary to the public interest. |
