Statutory Authority Section 25-7-101, et seq., specifically, C.R.S. Sections 25-7-105(12), ), 109(1)(a), (2) and (3); Section 25-7-301; Sections 24-4-103 and 25-7-110, 110.5 and 110.8 C.R.S., as applicable and amended.
Description of Subjects/Issues consider revisions to Regulation Number 7 to address the Environmental Protection Agency’s (“EPA”) partial disapproval (76 Fed. Reg. 47443, August 5, 2011) of Colorado’s Ozone State Implementation Plan (“SIP’). The SIP revisions under review were adopted by the Commission in December 2008, and submitted to the EPA in June 2009. The Commission will also consider revisions Section XVII to clarify state-only requirements, similar to those required in Colorado’s SIP.
Purpose/Objective of Rule Consider proposed changes to Regulation 7 to address regulatory provisions for oil and gas operations that EPA did not approve for inclusion into Colorado’s State Implementation Plan. The more significant revisions 1) remove the sunset date for the system-wide condensate storage tank control requirement applicable in the Denver/North Front Range ozone nonattainment area, 2) clarify that federally enforceable monitoring requirements cannot be replaced by state-only options, and 3) clarify that the first 90 day controls on condensate tanks are state-only requirements.
