Purpose/Objective of Rule STATEMENT OF BASIS AND PURPOSE FOR PROPOSED AMENDMENTS TO THE EMPLOYMENT VERIFICATION LAW RULES 7 CCR 1103-3 BASIS: § 8-1-107(2)(p), C.R.S., § 8-1-103(3), C.R.S., and § 8-1-111, C.R.S., provide the Director of the Division of Labor with the authority to adopt rules and regulations related to employers, employees, and places of employment. PURPOSE: The purpose of the proposed amendments to the Employment Verification Law Rules is to: further implement the provisions of § 8-2-122, C.R.S.; provide schedules of fines under the law; require the use of the Division-approved affirmation form; and clarify existing documentation review practices by the Division. Pursuant to § 24-4-103(4)(b), C.R.S., the Director finds that: 1) there is a demonstrated need for the rule; 2) the proper statutory authority exists for this regulation; 3) to the extent practicable, the rules are clearly stated so that their meaning will be understood by any party required to comply with the regulation; 4) the rules do not conflict with other provisions of law; and 5) the duplicating or overlapping of the regulation is explained by the agency proposing the rules.
