Purpose/Objective of Rule |
When an individual files an unemployment claim, the Unemployment Insurance Program (Program) sends a large amount of information regarding all requirements, which can lead to misunderstandings that can adversely impact benefit claims. The Program recognizes the complexities associated with the different requirements and proposes the following changes to help address it.
Improve communication with claimants in regards to what defines an active work search. The communications will include updating the claimant handbook with clear definitions and requirements and providing that information on the Web site. Additionally, staff will be well versed in the requirements and able to explain the requirements verbally, as well as direct a claimant to the written material.
Amend the rules related to actively seeking work to add clear definitions of what represents a work search. Additionally, add further explanation that a tangible record of contacts is required, what a tangible record is, and the length of time the record must be maintained by a claimant. The proposed language will provide both claimants and Program staff with clear guidelines of what constitutes an active search for work. This allows the Program to standardize the application of the law and regulations, which in turn, allows the law and regulations to be applied in a more stringent manner.
Add new rules allowing the Program to issue a formal warning, at its discretion, to a claimant who fails to meet the work-search requirements. When a warning is issued, the claim is flagged to establish that the work-search requirements have been clearly explained to a claimant and that follow up may be required by the Program. As part of that follow-up, the Program will increase the number of claims randomly audited for work-search verification. |
