Description of Subjects/Issues |
To consider revisions to Regulation Number 3, Parts A, B, C, and D. |
Purpose/Objective of Rule |
To adopt revisions to Regulation Number 3, Parts A, B, C, and D. Proposed revisions primarily address federal changes to the New Source Review (NSR) Program related to PM2.5 National Ambient Air Quality Standards (NAAQS); these proposed revisions are necessary for consistent state implementation of the federal NSR program. In addition, the Division is proposing revisions that address several recent Environmental Protection Agency (EPA) State Implementation Plan (SIP) actions in which EPA partially disapproved various SIP revisions. The Division is also proposing to incorporate into Colorado’s PSD and Title V Permitting Programs EPA’s Deferral of Biogenic Sources of CO2 Emissions to ensure consistent state implementation of greenhouse gas (GHG) regulation under the federal Prevention of Significant Deterioration (PSD) and Title V Permitting Programs. Finally, the Division is proposing to make other miscellaneous revisions and to correct typographical, grammatical and formatting errors. Proposed revision details are provided below.
Note the revisions to Regulation Number 3; Parts A, B, and D are SIP revisions. Regulation Number 3, Part C houses Colorado’s Title V Operating Permitting Program, which is a delegated program. Thus, revisions to Regulation Number 3, Part C are not SIP revisions.
Source affected by this proposal include PM2.5 and CO2 emission sources, as well as open burning sources, mobile sources, stationary internal combustion engines, emergency generators, oil and gas surface water impoundments, deaerator/vacuum pump exhaust, and air curtain destructors. |
