Statutory Authority CRS 8-20.5-302
Purpose/Objective of Rule The Aboveground Storage Tanks statute, Colorado Revised Statutes (C.R.S) Title 8 Article 20.5 Section 302 (including the Fuel Products statute C.R.S. 8-20 section 102) states that the Director of the Division of Oil and Public Safety (OPS) shall make, promulgate, and enforce rules for aboveground storage tanks installed before July 1, 1993, which rules shall be no more stringent than the rules in place on the date of installation, except as mandated by federal spill prevention, control, and countermeasures (SPCC) regulations promulgated by the United States Environmental Protection Agency (EPA). In addition, the statute states that the Director of the OPS shall make, promulgate, and enforce rules concerning the design, construction, installation, and operation of aboveground storage tanks permitted to be used and installed on or after July 1, 1993, which rules shall be no more stringent, either substantially or procedurally, than the requirements contained in the current edition of the national fire code published by the National Fire Protection Association (NFPA), as revised by the association from time to time, and in EPA SPCC regulations. Such rules shall be adopted by the Director of the OPS in compliance with C.R.S. 24-4-103. These amendments will update, revise, or clarify current Aboveground Storage Tanks Regulations. The amendments will also revise these regulations to correspond more closely with current versions of fire code as published by the NFPA and with the EPA SPCC rules.
