Statutory Authority These rules are promulgated pursuant to the authority granted the State Engineer in House Bill 09-1303, Section 3, as codified at Section 37-90-137(7)(c), C.R.S.; and Section 37-80-102(1)(g)
Description of Subjects/Issues These rules are intended to assist the State Engineer in the administration of the dewatering of geologic formations by withdrawing nontributary ground water to facilitate or permit mining of minerals.
Purpose/Objective of Rule To assist the State Engineer's Office (SEO) with administration where ground water is withdrawn to facilitate or permit the mining of minerals. The rules set out an adjudicatory process to petition the SEO for nontributary determinations and identify certain geologic formations within geographically delineated areas where ground water is determined to be nontributary by rule.
